DUI Checkpoints on the Rise Nationally

DUI Checkpoints are on the rise and will continue to rise.  According to a recent story in the Los Angeles time the number of DUI / Alcohol related death on California’s major highways has dropped to a record low number.  Also according to the Los Angeles paper,  last year 2010 marked the steepest drop in the number of fatalities due to drink driving in the last 14 years.  

Much of the drop in the number of Drunk Driving Related deaths in the highways of California are attributed to ever increasing campaign of enforcement by California Highway Patrol and massive funding for anti drunk driving campaign funding by the federal National Highway Traffic Safety Administration.   

In 2010, the feds massively increase the budget for drunken driving checkpoints. The federal governments  Office of Traffic Safety set up close to $17,000,000  in federal funds to law enforcement agencies.  In turn the state law enforcement agencies that received the money conducted more than  2,500 DUI checkpoint in 2009.  This number is a massive increase from the year before that saw only $12,000,000 in funding and only $17,000 checkpoints.

What does that mean to you
Since checkpoints are on the rise and as a result of the rise the federal funding have lead to a decrease in the number of drunken driving deaths we expect that there will be an increase in funding that will in turn lead an increase in the number of checkpoints.

In California, there are two separate charges which a person can be arrested, charged, and convicted because of DUI or drunk driving. 
·         Violation of Vehicle Code section 23152 (a), i.e., driving under the influence of alcohol or drugs. 
·         AND OR  Conviction based on Vehicle Code section 23152 (b).  To establish a violation of this law it must be proven that the person had a blood/breath alcohol level of .08% or greater at the time of driving. 
Many person charges with these two offense do not know the difference and do not know that there are different argument that can and should be made in order to protect the right of the person charged.

City DUI Checkpoint: Beverly Hills CA

"A Beverly Hills Police Department  DUI checkpoint at Sunset Boulevard and North Alta Drive scheduled for 6-10 p.m. Friday has been postponed due to a chance of rain in the weather forecast.
"It is cost prohibitive to set up and pull down a DUI checkpoint in the rain," Lt. Mark Rosen said. "It is also a danger to those operating it." 

The date and location of the next BHPD DUI checkpoint is yet to be determined. 
"We look at where we're having the most arrests and accidents because of DUIs," Sgt. Mike Foxen said when asked how checkpoint locations are planned.

When operating a DUI checkpoint, officers cone off a lane of traffic and typically stop three cars at a time at 15-car intervals, Foxen said. "We make sure there is no drinking and driving, and check driver's licenses," he said. The number of cars stopped may vary based on how busy the roads are.
"We don't want to hold up traffic," Foxen said.
